Minutes of the Ordinary Meeting

153/03/10 Apologies for absence were received from Mr H.Harrison.
154/03/10 Public participation:
154.1 Shap Swimming Pool representatives Mrs Claire Miller (committee) and Mr Peter Allan (supporter) gave a presentation on the current state of the Swimming Pool.
154.2 The representatives wished to clarify their position with regard to the Parish Council.
154.3 The Pool will be 25 years old in 2012 and is showing its age.
154.4 It is in good hands with a good committee running it. They have a zero tolerance on trouble, and they have support from the PCSO. All the committee are committed to the safe running of the pool. Water quality checks have to be carried out twice daily and these can take up to an hour each time; at busy times checks have to be carried out four times daily. The climate can affect the water balance. Several older people help out in the shop but there is also a rota of regular helpers.
154.5 Last season saw ticket sales increase, with happy customers and favourable comments on the Shap website.
154.6 All cleaning and repairs are checked by Eden District Council.
154.7 There have been two successful fund-raising events.
154.8 On the financial side, the pool costs £250 per month to run in winter.
154.9 Greystoke and Askham pools have been closed due to their condition, so Shap is the only local pool in operation.
154.10 In 2009 costs were up £1200, expenditure was down by 5 per cent They made a loss of £1100, the entries were up, the shop turnover is fairly static; and less was spent on repairs than in 2008.
154.11 The committee are now looking for funding from various sources.
154.12 There were images of some of the pumps, one was replaced last year at the cost of £1700, and the small back-up pump is not working, this would cost £800 to replace.. The heat exchange mechanism would cost £1000 to replace, and once replaced it would save on running costs.
154.13 The paddling pool was not open last year because of its condition, some benches need to be replaced, windows and doors are now beginning to show signs of rot, the render is also coming away from the walls following winter frost and flags require re-grouting.
154.14 The Chairman said that there was a licence between the parish Council and the Swimming Pool, this meant that should the pool ever close, the ownership would revert back to the Parish Council.
154.15 The Parish Council are able to provide financial support on a one-off basis. Cllr Warburg said that the Parish Council had bought equipment in the past.
154.16 EDC Cllr Hughes said that sharing services with South Lakeland District Council would save £50,000-£100,000, but vulnerable services such as leisure would most likely suffer. Eden District Council gave grants of £500 to Shap swimming pool.
154.17 CCC Cllr Lowther said that the Neighbourhood Forum might be able to assist, and he would make an approach for £2000, he invited Mr Allan to attend the next meeting to present the information.
154.18 Cllr Warburg asked if there was a specific project that would cost about £1000 that the Parish Council could consider. The Swimming Pool Committee will feed back on this.
155/03/10 Minutes of the Ordinary Meeting held on 8th February were signed as a correct record.
156/03/10 Declarations of Interest – None.
157/03/10 Finance
157.1 Council RESOLVED to approve the statement of accounts to 28th February 2010. Proposed Cllr Hodgson, seconded Cllr Sowerby.
157.2 Council RESOLVED to authorise payments of the following accounts:
Wages – 5 March to 26 March 2010. £507.25
Clerk’s Salary February 2010. £308.20
Clerks Induction Course fee £40.00
Post office counters £15.60
£871.05
157.3 Budget Update; copies were made available to Councillors; the bank interest had dropped drastically, and recycling is now paid six-monthly, The budget is down £300 on income. There is a surplus of £3,328.58 for the year. Council RESOLVED to accept this, proposed, Cllr Weightman, seconded Cllr Watson.
157.4 Grants to local organisations as approved at the last meeting were made as follows:
Shap Pavilion Club, £500.00 Proposed Cllr Stainton, seconded Cllr Mallinson there was
one abstention.
Great North Air Ambulance £250,00 Proposed Cllr Hodgson Seconded Cllr Warburg all agreed.
Shap Pre-School Playgroup £500.00 Proposed Cllr Bindloss, Seconded Cllr Mallinson all agreed.
Total of grants £1,250.00.
158/03/10 Planning
158.1 Withdrawal of application 09/0996 – Erection of joinery workshop – Holme Lea, Shap. Application withdrawn 08/02/2010.
159/03/10 Tennis Courts.
159.1 An estimate for repairs has been received from Frank Grundy. This is for £1,425.20 Council RESOLVED that this be accepted. Proposed Cllr Warburg seconded Cllr Mallinson. Cllr Stainton said that in future more than one estimate should be invited. Clerk will contact Mr Grundy to accept his estimate and request that he starts works as soon as possible.
160/03/10 Pavilion Insurance.
160.1 The pavilion is on licence from the Parish Council, but the financial statement from the committee does not show any payments for insurance, the Chairman said that representatives from the committee be invited to attend the next meeting to discuss the insurance arrangements and other matters.
161/03/10 Waste Bins.
161.1 The top of the waste bin on the car park has disappeared. Council RESOLVED that a replacement be purchased. Clerk to attend to this.
162/03/10 Natural England/National Parks consultations.
162.1 No one from the Council had attended any of the presentations. The planned extensions to the National Parks would only affect a small area to the south of the village that was felt to be insignificant, and Council asked that it be minuted that they felt that they had nothing to contribute.
163/03/10 Confirm dates for Annual Parish Meeting (19th April) and meetings scheduled for 5th April and 3rd May (Bank Holidays)
163.1 The Annual parish Meeting will be held in the Green Room at the memorial Hall on Monday 19th April. It is hoped to invite outside bodies to speak. EDC Cllr Hughes gave his apologies for that meeting.
163.2 Council RESOLVED that the meetings for April and May be held on the following dates: Tuesday 6th April and Tuesday 4th May.
164/03/10 Correspondence.
164.1 An anonymous letter regarding the land between Wasdale sheltered housing and West Close had been received. This complained about the condition of the area where there is a public footpath. The Chairman and Clerk had visited the site to assess the situation and spoken with the Site Manager. The Clerk had written to Thomas Armstrong Construction asking them to make sure the area was left in good order when the construction work was finished. Clerk had visited site again on the day of the meeting and found a vast improvement and was assured that all would be left in good order.
164.2 EDC New Procedure Application Non-Material Amendments
164.3 EALC notice of meeting on Tuesday 30th March, Cllr Warburg expressed a wish to attend and the Clerk will forward the agenda as soon as it is received.
164.4 CCC Highways, response to Clerks letter re: road markings, this confirmed that work was to be undertaken.
164.5 EDC Scrutiny Work Plan
164.6 CCC Maps and location lists for street lighting – to be held on file.
164.7 CALC Spring Training Programme. The Clerk is to attend two sessions.
165/03/10 Matters to report
165.1 Cllr Sowerby reported lights not working at mountain View and outside 16 Gayle Avenue. Clerk will report these.
165.2 EDC Cllr Hughes had suggested to planners that the Sports Hall site could be suitable for a skating rink, he also felt that extra dog fouling bins need to be provided.
165.3 Cllr Warburg had attended a meeting regarding community development.
165.4 Cllr Watson reported two loose manholes on Skew Bridge, and said that trees above the cemetery were in need of pruning, also some at the top of Rosgill.
165.5 CCC Cllr Lowther enquired whether the Council had received any correspondence regarding signage. The Clerk said that they had not.
165.6 The Chairman said that the plastic recycling cage had been causing some confusion. This was only temporary and would be replaced with a regular one shortly.
166/03/10 After the public had left, the councillors discussed matters of employment.

168/03/10 Apologies for absence were received from Cllr Warburg.
169/03/10 The meeting was held in order to discuss the Planning Application No. 09/0920 – Change of use from restaurant/guest house to house in multiple occupation. Fell House, Main Street Shap. For Mr L. Mushandu.
170/03/10 The Parish Council had received a letter form Karen Thompson the Development Control Officer for Eden District Council advising then that the Planning Application Committee had deferred their decision to allow Shap Parish Council to make comments of the application.
171/03/10 A report for debate form the Planning Application Committee was read and discussed.
171.1 The Committee had received five letters of objection from neighbouring residents to and a petition with 12 signatures.
172/03/10 The comments raised had been summarised in the report.
172.1 Parking: There were many concerns regarding parking, and it seems that the Highways Department were not concerned enough to make any objection.
172.2 Vehicles parked in front of the property causes a restricted view for neighbouring residents trying to leave their driveways meaning that they have to pull right out onto the highway before they can check for oncoming traffic.
172.3 The bus stop is also blocked, so the bus has to stop on the main road across a junction to a side road.
172.4 There is space at the side of the property for approximately four vehicles. On the day of the meeting there were two vehicles parked there and a van across the garage, a further vehicle was parked at the front of the premises.
173/03/10 There were also concerns regarding Environmental Health issues,
173.1 Noise emissions are already substantial, and have been reported to the Environmental Health Department.
173.2 Fire Safety provision caused concern. Especially as there was no owner supervision in the building.
173.3 The general maintenance of the building needs to be addressed, as it is well below the acceptable standard at present. The signage for the restaurant should be removed as it is no longer relevant. The roof is in poor repair with loose slates. The coverings to the downstairs windows are not suitable for a rural village. One window had a sheet jammed into it because it could not be closed properly.
173.4 Waste storage, this needs to be addressed.
174/03/10 The Council would like to see all these issues addressed before any permission was granted.
175/03/10 The meeting wondered whether representatives from the Eden District Council had visited to property to see the situation for themselves.
176/03/10 It was reported that members of the public come to use, what appears to be, gymnasium equipment in the garage, and this increases the number of parked vehicles.
177/03/10 It was also reported that an overflow it left running constantly; although this is not an issue for the council.
178/03/10 The impact on nearby residents and occupiers of neighbouring properties is great, and they feel intimidated, and there is a great feeling of insecurity.
179/03/10 The property currently holds a drinks licence, and the council wish to know whether this would be relinquished, and if in future the property was sold, would it be as a guest house and restaurant.
180/03/10 The meeting AGREED that the clerk should compose a letter to be sent to the Planning Applications Committee, and a copy is to be sent to an EDC Councillor who can monitor the discussions.
