136/01/10 Finance
136.1 Clarification of Cumbria County Council payment this was funding for Parish Paths Initiative; refund of monies paid in respect of work on path alongside Sports Hall. Council RESOLVED to approve the statement of accounts to 31st December 2009. Proposed Cllr. Weightman, seconded Cllr Mallinson.
136.2 Council RESOLVED to authorise payment of the following accounts:

137/01/10 Planning applications
137.1 09/0996. Erection of Joinery Shop at Holme Lea. There was concern that the Parish Council were out of time for raising any objection since there had been no meeting since the application had been received. Several councillors expressed concerned regarding proximity to neighbouring properties; noise and disturbance, and whether there should be a restriction of working hours. It was felt that a site visit may be beneficial in order to clarify matters. Cllr Weightman proposed that a letter be composed and sent to Eden District Council. Majority approved. One against, one abstention. The Parish Council will send a letter with their comments and urge Eden District Council to arrange a site visit.
137.2 09/0920. Change of use from restaurant/guest house to house for multiple occupation. Fell House. The wording ‘multiple occupancy’ does not appear on the application form. Cllr Warburg will telephone Eden District Council to clarify this matter.
137.3 09/0568 Peggy Nut Croft. The Parish Council had late delivery of notification for the planning committee meeting. The Chairman had telephoned Kevin Hutchinson at Eden District Council and had been assured that concerns had been considered. The Chairman will write to Eden District Council expressing concern that comments were not acknowledged or responded to. An on-site meeting with the planning officer should be held to discuss levels, as the report stated ‘no flooding risk’, when Councillors are concerned that there could be an issue with this.
137.4 09/1212 Change of use of agricultural land to domestic curtilage and erection of timer store Fairview, Shap. This application had only been received on the morning of the meeting so did not appear on the agenda. There were no objections raised.
138/01/10 Correspondence
138.1 Eden District Council Draft proposed budget: Cllr Warburg has looked at this document briefly. EDC Cllr Hughes said that he believed that this was the first time that these had been issued, and that this was a tight budget and Z-rated facilities may be affected.
138.2 Eden District Council. Late payment of recycling credits. July- September payments not due for payment until January 2010 due to Trading Standards investigations.
138.3 Cumbria County Council. Minerals and Waste development framework. Cllr Warburg said that at present there was nothing to affect Shap. There is planning in for a waste handling site at Tebay, he will try to clarify the nature of this.
138.4 Eden Housing Association. Update on refurbishment at Wasdale. Work is now well underway with completion of Phase 2 anticipated for mid February 2010.
138.5 Citizens Advice Bureau. Request fro financial support, this matter to be deferred to another agenda.
138.6 Eden District Council. Re: light on Gayle Avenue which is not working. Letter informs that the matter is on their list for attention.
138.7 Cumbria Police Authority Notice of Liaison Forum Meeting to be held on 13th January 2010 at 7p.m. in the George Hotel, Penrith
138.8 Eden Rivers Trust. Newsletter.
138.9 Natural England (by E-mail) Re: Lake District National Park and Yorkshire Dales National Park extension. Notice of briefing event to be held in Newbiggin-on-Lune Village Hall on 12th January 2010. Cllr Weightman expressed an interest and plans to attend.
139/01/10 Matters for report
139.1 Cllr Sowerby reported that the road through the village is in poor repair especially around manholes. The salt bins have now been filled and some pavements salted. He also expressed concern about vehicles parking at Woodville Terrace, as these impede the passage of disability scooters, with people using tem having to go onto the road to get past parked vehicles.
139.2 EDC Cllr Hughes reported ice bound roads, and Rosgill residents not having had a refuse collection fro three consecutive weeks, he has made a complaint to Eden District Council about this.
139.3 Cllr Warburg quoted from a statement that Cumbria Highways Authority was responsible for the roads, not the District Council, and they would only treat major routes, the remainder was down to individuals using grit bins.
139.4 Cllr Weightman was concerned about the future of the Concrete Road, and requested that Paul Phillips the representative of United Utilities be invited to attend the parish Council meeting in February. It was suggested that perhaps Bampton Parish Council also be invited.
139.5 Cllr Weightman raised the matter of having a footpath to the new Medical Centre and asked why this had not been raised when the plans were under discussion; the Chairman said that the rear is a secure area so no access would be possible through that area. Cllr Weightman asked whether access could be made through the Sports Hall site, the Chairman said that the site belonged to Cumbria County Council so permission for public access would have to be obtained from them. She also said that this was matter for the Medical Centre. Cllr Weightman said that the road to the Medical Centre had not been gritted; Cllr Warburg will write to Cumbria Highways asking for this access to be added to their priority routes. A letter to be written to the Primary Care Trust regarding access to the Medical Centre.
139.6 Cllr Mallinson said that South Lakeland District Council had quad bikes for use when spreading salt on non priority routes.
