Minutes of the Ordinary Meeting
Tuesday 6th April 2010 at 7.30 pm

1/4/10 Apologies for absence Cllr H. Harrison.
2/4/10 Public Participation. Mr Trevor Stamper representing the Shap Pavilion Club, attended at the request of the Council to answer some queries regarding the arrangements for insuring the building. Mr Stamper said that there was no building insurance in place, stating that the problem arose because it was not a building for habitation. However there was Public Liability insurance through the football club. The Chairman stated that the building had been insured in the past possible three or four years ago, but the criteria may have changed on what kind of insurance is available from insurers.
3/4/10 The Minutes of the Ordinary Meeting of 1st March 2010 were signed as a true and accurate record.
3.1 Minutes of the special planning meeting held on 25th March 2010 were also signed as a correct record.
4/4/10 Declarations of interest
Cllr Jackson and Cllr Bindloss both declared an interest in item 9.1 CDC request for sponsorship
5/4/10 Finance
5.1 Council RESOLVED to approve the statement of accounts to 31st March 2010. Proposed Cllr Sowerby, seconded Cllr Hodgson.
5.2 Council RESOLVED to authorise payment of the following accounts:

6/4/10 Planning applications
6.1 3/10/9003 Construction of Waste Water Treatments works near Nook Farm, Shap. Cllr Warburg reported that he had tried to speak to the person named as the contact for this application in order to establish the size of the building and any planned screening of the site. There were no further comments or objections.
6.2 10/0163 – re-submission of planning application 09/0950 for stable at Brackenber Lodge to include a hay store. Council raised no objections.
6.3 Planning application 09.0920. Change of use to a house for multiple occupation – Fell House, Shap – update on special meeting held on 25th March 2010. All Councillors had received copies of the minutes from this meeting. The clerk had written to Kevin Hutchinson the chief Planning Officer outlining the concerns of the public. An email had been received from Mr Hutchinson advising that the Planning committee would next meet on 15th April, when this application would be discussed further and the response of Shap Parish Council will be reported to the committee.
6.4 Planning decision – 09/1087 – conservatory at 1 Avondale Cottages, Wickersgill – GRANTED
6.5 Planning decision- 09/1055 – change of use of land from agricultural to domestic Fairview, Shap – GRANTED
6.6 Planning decision -7/2010/3003 Telecommunications development at Haweswater Valve Chamber. GRANTED
7/4/10 Sports Pavilion
7.1 Councillors discussed the matter of insuring the building further. Mrs Ashburner had not been able to attend the meeting, but the situation needs to be investigated further and quotes or estimates sought by her to insure the building for approximately £50,000.
8/4/10 Annual Parish Meeting
8.1 The meeting will be held on Monday 19th April at 7:30p.m. in the Green Room at the Memorial hall.
8.2 Several meetings have been held over the last few weeks with others regarding the Parish Plan of 2005. It has been decided this could be used and simply updated.
8.3 There are concerns regarding unemployment.
8.4 The Annual Parish Meeting will be used as an opportunity to tray to establish interest in the village’s future. Posters have been distributed headed ‘Shap-The Way Ahead’.
8.5 Several village facilities have gone and sources of employment.
8.6 It is hoped that representatives of Cumbria Rural Enterprise Agency and other bodies will be at the meeting so that the public can ask questions and say what they would like to see for the future in the village.
9/4/10 Correspondence
9.1 Shap CDC request fro sponsorship of two issues of Shap Today for the coming year. Council agreed that this be done Proposed, Cllr Warburg, Seconded, Cllr Mallinson, there were two abstentions.
9.2 Resource - Issue 14 recycling leaflet – to be held on file.
9.3 Shap Pavilion Club, acknowledgement of grant.
9.4 Thomas Armstrong Construction by email re: land adjoining Wasdale Sheltered Housing. The email assured the council that the site would be properly tidied up before the contractors leave the site. Clerk reported that the site appears to be winding down, and there is still some heaps of soil on the footpath, she will monitor the situation and if necessary contact them again.
9.5 EDC Planning Department. An email and letters had been received advising that the decision on the Fell House planning application had been deferred until Shap Parish Council could hold a meeting to discuss the application further and advise the Planning Committee. (See note 6.3)
9.6 .Great North Air Ambulance, acknowledgement of grant.
9.7 Lake District National Park Authority update and news, dates and venues for planning seminars. To be held on file.
9.8 Cumbria Police Authority notice of forum meeting at Kirkby Stephen on 21st April. No action.
9.9 CALC training opportunities ‘An Introduction to Open Space Protection’, various dates in April and May an venues. Free event booking required. No interest expressed.
9.10 Penrith Rotary Club request for nominations of people who have given exceptional service to the local community. Nominations close 18th May. No names submitted at meeting.
9.11 EDC Rates advice.
9.12 AON Insurance – Chairman asked for volunteers to form a sub committee to discuss and review the insurance arrangements. Cllrs Warburg, Watson and Hodgson agreed to act. A meeting will be held on Monday 26th April at 10a.m.
10/4/10 Matters for report
10.1 Cllr Watson reported that the road marking on the slip road from the M6 has still not been re-painted. The Clerk confirmed that this had been reported to Highways dept and the request had been acknowledged.
10.2 Cllr Watson also stated that public conveniences were in the Z list for council cuts. There would be a meeting on 22nd April for action in October and November.
10.3 Cllr Watson is planning to attend the CALC renewables meeting on 22nd May.
10.4 Cllr Stainton reported a car that had been parked on Gayle Avenue, was bow parked in the Swimming Pool car park since its licence had expired. Chairman said the situation was a matter between the Swimming Pool Committee and the individual concerned.
10.5 Cllr Stainton expressed concern regarding a house being used for running a business, the property was now being linked to the adjoining property, and he queried whether an application for change of use had been made.
10.6 Cllr Sowerby reported an open drain on the Keld road which several cars had got into. Clerk knew the location. He also reported potholes in West lane near the former surgery and on Kirkbank. He reported having seen two dogs running loose in land near Castlehow Scar.
10.7 Cllr Sowerby expressed concern regarding recent break ins, he inquired whether there has been any further news.
10.8 This has been unsettling for the community as a whole, and it is important that a representative from the Police be present at the Annual parish meeting.
10.9 Nat West Bank has been closed on several occasion recently due to lack of staffing, the Council will write to ask what arrangements are for future opening the branch.
10.10 Cllr Weightman asked if the council could write to the Post Office regarding a replacement for he post box in Rosgill than was damaged by vandals. Cllr Sowerby said that the one a Sleagill damaged at the same time had been replaced.
10.11 Cllr Weightman said that he had no further news regarding tree clearance by United Utilities,
10.12 Cllr Hodgson expressed concern about dogs fouling in fields, this problem was on the increase. Where there is a footpath through a field dogs should be kept on a lead. He asked if the Council could write to the dog warden about the problem. Sandy Lane was reported to be badly fouled. Clerk said that she had been in contact with the dog warden asking for an article for Shap Today, so far this has not been forthcoming.
10.13 Cllr Warburg had attended the EALC meeting, those present included the Eden Housing Association, EDC Chief Executive and legal Officer.
10.14 Cllr Mallinson reported that there was a lot of rubbish on Cross Garth – discarded domestic furniture and equipment Council to write to Eden Housing Association regarding this..
