76.3 Council RESOLVED to agree to virement of money from reserves to cover cost of Car Park Walling. The total cost excluding VAT was £1910.00 and £1000.00 had already been budgeted for, therefore the amount of £910.00 to be transferred from reserves.

77/9/09 Planning applications
77.1 Notice of Withdrawal of Application - 09/0535 Proposed New Dwelling - 7 Foster Street, Shap.
77.2 Notice of Decision - 09/0383 - Proposed single storey extension to side of house - 1 Unity Terrace, Shap. Permission Granted.
77.3 08/0209 - Redevelopment of Former Methodist Chapel - Amendments to planning approval, minor works that the council consider will not have a negative impact on the appearance or have an adverse impact on the privacy or amenities of neighbouring properties.
78/9/09 Quarry Liaison Meeting - to advise all councillors and interested parties that the next meeting is to be held on 12 October 2009 at 10.30 am. Agreed to invite Cemex to the meeting.
79/9/09 Recycling Credits - Council was advised that our second instalment of recycling credits has been received and amounts to £884.86 which covers 2 quarters from Jan 09 to June 09.
80/9/09 Shap Village Recycling Centre - A new adoption agreement for the period 2009-2014 has been received and needs to be signed and returned to Eden District Council. Flytipping is a problem and our street cleaner does clean regularly. A letter from our street cleaner was read to the meeting. The Plastic bins need to be swept under when changed and our street cleaner was asked to keep a log of hours spent cleaning this area. Council agreed that the clerk to send a letter stating that we are prepared to keep the area clean but need quicker action from EDC when it is left in a mess, particularly on Mondays. Suggest J Lowis to advise on a Monday if a mess and clerk to report this to EDC. A vote on whether to sign the agreement was taken. Proposed: Cllr Warburg. Seconded: Cllr Hodgson. Votes cast - 6 in favour. 3 against. Motion carried and agreement to be completed and signed and sent to EDC with a covering letter regarding cleaning under containers and clearing flytipping on Mondays and Thursdays.
81/9/09 Bus Shelter - Clerk advised Council that progress seems very slow but Martin Elson from Kendal has been in touch and is trying to arrange a site visit when he is in the area dealing with other local parishes. The clerk to continue to contact Martin Elson to progress a site visit.
82/9/09 Shap Beck Quarry Visit - Councillors made a visit to the quarry on 26 August 2009. Cllr Jackson gave a report on the visit. Turnout was disappointing as only two councillors and Neil Hughes attended. She reported that it was a fascinating visit. Tom Felix gave a very good presentation, they performed a blast for them. She also reported that the provision for wildlife was excellent and the geology and stone face interesting.
83/9/09 Shap School Crossing - an update was given to the meeting regarding the site visit. Council was advised that the issue with access for The Crown had been resolved before the meeting. There was concern that the road was being narrowed but this is not the case and the road will now be the same width all the way along in this vicinity. The main concern is that the barriers will extend over the Memorial Hall Car Park and a letter has been sent to them following the site visit. To date no reply has been received.
84/9/09 County Councillor Tom Lowther attended the meeting and gave more information on the £12,000.00 that each County Councillor has been allocated to spend in their constituency. He advised that the money can only be spent on Capital expenditure and more detail will be given to County Councillors at their next meeting. He will advise on this. The money can be spent going forward to the next year and using £24000.00 or they can join together with other Councillors to pool the money. Councillors advised Tom Lowther that Shap would be interested in new signage - i.e brown tourist signs. Liaison to be undertaken between Tom Lowther and Shap Parish Council when more detail from County Council has been obtained.
85/9/09 Parish Paths Initiative - Following two site meetings with Tony Burns and Andrea Bonacker an update was given to the meeting. The path behind the Sports Hall and towards Peggy Nut Wood is the area in question. Tenders are being sought for a kissing gate and the plan is to strim the area at the village side of the Sports Hall to make the path more inviting. Proposals are that half way down the path is a wooden stile, and this will be removed, and at the bottom, the stile is to be removed and replaced with a kissing gate. Steve Adcock from Capita is not interested in doing anything with the stone stile at present but in the future when the Sports Hall is sold we will look into rebuilding or removing it. PPI will fund £600.00 to do this work, and for the future they will fund a bi-annual strimming of the path. SPC will need to pay contractors and will then be reimbursed. Councillors need to approve that Council go ahead and get quotes for the Kissing gate and the strimming. Once quotes are received PPI will approve and agree that we can go ahead with the work. Proposed: Cllr Weightman. Seconded: Cllr Hodgson.
86/9/09 Shap Play Area - Play House - Council were advised that the Play House has been removed and that EDC would like to site the new one in a different area. Photos of the area by the gate and by the seat were shown to Councillors and they agreed to the proposals for the new siting. Also to notify Councillors that another piece of equipment is defective - the scramble net, and that EDC are trying to get replacement parts to repair it.
87/9/09 PC N Hodgkinson and CSO S Brownrigg - attended the meeting and were invited to speak at the beginning of the meeting, as they had another meeting to attend. They advised they were attending the meeting for Councillors to ask questions and report incidents. They have nothing to report on the Co-op burglary. There have been some complaints of youths revolving around alcohol and the people around the playing field are the most disturbed. The Bus Shelter trouble is much improved due to a small group of young people looking after it. Cllrs reported that there were problems with boy racers on the concrete road. This had been tried to be reported but because the call went through to a call centre they did not have a clue about the area. Three lambs have been killed in recent weeks. PC Hodgkinson advised that policing is difficult as it is a private road. Cllrs questioned whether it was classed as a road or a public road even though the signs say private property. PC Hodgkinson to look into this. Cllrs also reported that the bus stop at the N end of the village on the West side of the A6 is obstructed by cars, but there are no road markings so this is not an offence.
88/9/09 Correspondence
88.1 Council acknowledged receipt of an update from John Banks, Capita Symonds regarding the problems reported at the last meeting. The pole housing the school crossing lights will be replaced. The manhole outside the Gents has now been replaced. The drain outside the Co-op/Launderette - the gully frame needs resetting but is not urgent. He requested confirmation that the sign for Shap in Pow Lane was just a sign saying Shap. Clerk advised that he had been advised that this was the case.
88.2 Council acknowledged receipt of a reply from Alan Harty, Capita Symonds, confirming that Shap Sports Hall had not been sold.
88.3 Council acknowledged receipt of updates from Thomas Armstrong regarding the New Health Centre at Shap dated 31 July 2009 and 28 August 2009. Advised that at this point they considered the contract to be running 4 weeks behind schedule.
88.4 Council acknowledged receipt of confirmation from our insurers that the Car Park Wall is now covered for the sum of £2000.00 and this is all risks cover. Therefore any damage must be photographed and reported to our insurers before any repair is undertaken.
88.5 Council acknowledged receipt of an update from Eden Housing Association regarding Wasdale Remodelling.
88.6 Council acknowledged advance notification of the Annual General Meeting of Eden Association of Local Councils to be held on 16 September 2009 at Appleby.
88.7 Council acknowledged receipt of a notification of a CIEP free event ‘How Parish Councils can win friends and influence people' various dates and venues - September, October and November. Cllr Warburg agreed to look at dates with a view to attending.
88.8 Council acknowledged receipt of advance notice of consultation for the final consultation on the draft policies in the core strategy of the Local Development Framework for the National Park from 21 September to 30 October 2009, which replaces the old planning structure.
88.9 Council acknowledged receipt of notification from Cumbria County Council of Cumbria Housing Group - Strategic Housing Assessment consultation.
88.10 Council acknowledged receipt of publication Local Access Forum Annual Report.
88.11 Council acknowledged receipt of publication from Resource Cumbria re recycling entitled ‘Review'.
88.12 Council acknowledged receipt of notification from CALC of a VAT workshop to be held in Manchester.
88.13 Council acknowledged receipt of notification from CALC of Training and Advice sessions for Chairmen.
88.14 Council acknowledged receipt of correspondence regarding Shap Silly Sports Day to be held on 20 September 2009. Clerk to write and advise that permission is given for the Memorial Park to be used.
88.15 Council acknowledged receipt of Cumbria County Playing Fields Association - Annual Report 2008/09.
88.16 Council acknowledged receipt of notification from Eden District Council advising of the new leader - Keith Phillips.
88.17 Council acknowledged receipt of an update regarding Disabled Childs' Access, advising that Highways are dealing with the matter and Stella Robinson, Access & Diversity Officer from EDC is checking on progress.
88.18 Council acknowledged receipt of the Agenda for Lake District Parish Councils Meeting to be held at Brockhole on 17 September 2009 at 7pm.
88.19 Council acknowledged receipt of CALC Circular Sept 2009, advising CALC AGM 14 Nov 2009.
88.20 Council acknowledged receipt of publication ‘Clerks & Councils Direct' September 2009.
88.21 Council acknowledged receipt of notification from EDC on Consultation on Proposals for Penrith New Squares. Eden District Cllr Hughes encouraged people to respond to the consultation.
88.22 Budget Update preparation for setting the Precept, a committee to be formed after the October meeting.
88.23 Standing Orders Review - a major review to be undertaken and Cllr Warburg offered to do a review as a first step and to bring to the October meeting.
89/9/09 Matters for report
89.1 Cllr Sowerby reported that several manholes in the village have the tarmac breaking up around them. Also two drains outside Trewint on the main road are blocked and the one at Simpsons Garage.
89.2 Cllr Hodgson has received reports that the path south of the Greyhound has become too narrow (with grass and soil) for two people to walk along. EH to investigate. With the recent bad weather there has been serious flooding on A6 from Corus from under the railway bridge. Suggested that a site visit be arranged with Alastair Dunn, Corus before the next liaison meeting to discuss.
89.3 Eden District Cllr Hughes advised about the new EDC Leader. He has also asked Keith Masser regarding ‘Shap Village Enhancements' and what chance of being completed soon, but advised could be several years before completion. Councillors advise that enhancements mean parking and removal of crazy paving but SPC have no details of plan.
89.4 Cllr Warburg advised that there are notifications in the paper for Wayleave applications and BT are putting up replacement telegraph poles, but the new ones are taller.
89.5 Cllr Watson reported that the manhole at Simpsons Garage is flooding. Also at the cemetery the gap between the lay by and the road is widening and there was flooding by Kirkbank bridge again and it brought a wall down.
89.6 Cllr Bindloss queried whether there has been a drain put in the field by the New Medical Centre by the contractors Thomas Armstong.
89.7 Cllr Jackson reported that the school had been given money by SPC for hanging basket plants and was pleased to report that they were awarded a Certificate of Merit by Cumbria in Bloom. Hopefully next year this will be repeated. They were let down by rubbish in the bus shelter.
89.8 County Cllr Lowther reported that he had had a meeting with Invest in Cumbria and NW Development Agency regarding the sausage factory. He had also had a meeting with New Balance. There is going to be a Neighbourhood Forum Drop In - possibly in November. It will be advertised and is for people who are losing their jobs to go to for advice and help.
